UPick is an iOS app provided by Domus Antonia Lux LLC (d/b/a UPick). The app includes both free and paid features. By using the app or creating an account, you agree to these Terms of Service. If you do not agree, do not use the app.
You must be at least 13 years old to create an account. By creating an account, you represent that you are at least 13 and that all information you provide is accurate and current.
You are responsible for keeping your account secure and for all activity that occurs under it. Do not share your login credentials. Each person may have only one account. You may not impersonate any other person.
You retain ownership of your three-word reviews, longform notes, ratings, and any other content you post ("Your Content").
By posting Your Content, you grant UPick a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to reproduce, display, distribute, format, and make derivative works of Your Content solely for the purposes of:
By default, we include your activity and taste data in anonymized, aggregated datasets to improve recommendations, conduct research, and license to third parties. You may opt out of this at any time on the Your Privacy Choices page of this website; the app's Profile → Your Privacy Choices screen links you to that page.
If you do not opt out, you grant UPick a perpetual, irrevocable, royalty-free, worldwide, sublicensable, and transferable license to collect, aggregate, and use your activity and taste data in de-identified, aggregated datasets. "Aggregated" means data combined across at least 50 users with all personal identifiers removed.
This license survives account deletion or termination for any data that was already aggregated before you opted out or deleted your account.
We may publish, share, or commercially license these aggregated datasets to third parties for research, analytics, or product development.
You can change your preference anytime. If you opt out, no new data from your account will be added to future aggregates, but previously aggregated data remains in those datasets.
You may not post content that is illegal, contains slurs or threats, infringes third-party rights, or violates our Community Guidelines. We use automated tools to flag obvious violations and manually review reports within 48 hours.
UPick offers both one-time purchases and auto-renewing subscriptions. All payments are processed by Apple.
One-time purchases (UPick+ One-Time, UPick+ Lifetime, UPick+ Early Adopter): You pay once. There is no recurring charge. These purchases include the paid features available at the time of purchase.
Auto-renewing subscriptions (UPick+ Monthly, UPick+ Yearly): Charged at the beginning of each period. You may cancel anytime through your iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.
Refunds: All refund requests are handled exclusively by Apple according to Apple's refund policies. We do not issue refunds directly. If Apple denies your request and you believe you have a valid issue under applicable consumer law, contact [email protected]. We will review on a case-by-case basis.
We may add, modify, or retire features over time. No refunds or credits will be issued for feature changes or retirements. Your purchase entitles you to the paid features included in the then-current version of UPick+, not to any specific feature in perpetuity.
Movie metadata is licensed from TMDB. Streaming availability data is provided by Movie of the Night. Streaming services and their logos are the property of their respective owners. We do not host or stream any video content.
The app and all services are provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that any recommendations will match your taste or be accurate.
To the maximum extent permitted by law, in no event shall Domus Antonia Lux LLC, its sole member, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim (which is typically zero for free users). This limitation does not apply to:
You may delete your account at any time through Profile → Account → Delete Account. We may suspend or terminate your account if you violate these Terms; we will notify you of the reason when required by law.
These Terms are governed by the laws of the State of Alabama without regard to conflict-of-laws principles. Any disputes not subject to arbitration (see Section 10) shall be brought exclusively in the state or federal courts located in Montgomery County, Alabama.
If we make a material change to these Terms, we will notify you in the app and by email at least 14 days before the change takes effect. Your continued use of the app after the effective date constitutes acceptance of the new Terms. If you do not agree, you must delete your account before the effective date.
Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Montgomery County, Alabama (or virtually if you prefer).
You and UPick agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
You may instead pursue your claim in small claims court in your county of residence if the claim qualifies. This agreement does not require arbitration of disputes involving your or our intellectual property rights (including copyright, trademark, trade secret, or patent claims).
You may opt out of this arbitration agreement by sending an email to [email protected] within 30 days of the date you first accepted these Terms (or the date this arbitration provision was added). The opt-out must include your full name, Apple ID associated with your account, and a clear statement that you are opting out of the arbitration agreement. If you opt out, the remainder of this section does not apply to you.

These Terms constitute the entire agreement between you and UPick and supersede all prior agreements. If any provision is held invalid, the remainder remains in full force. Our failure to enforce any right does not waive that right. We may assign these Terms; you may not. Headings are for convenience only.
By using UPick, you acknowledge that you have read, understood, and agree to these Terms.
